It is thus responsible for the collection, processing and use of your personal data as well as for the compliance of the data processing with the applicable data protection legislation.

We obviously comply with the legal provisions of the New Federal Data Protection Act (nFADP), the Ordinance on the Federal Data Protection Act (PLOD), the Telecommunications Act (LTC) and other data protection provisions of Swiss or EU law that may apply, in particular the General Data Protection Regulation (GDPR).

1. Visiting our website

When you visit our site, our servers temporarily record each access in a log file. The purpose of collecting and processing this data is to enable the use of our website (establishment of a connection), to guarantee the security and stability of the system in the long term and to enable the optimisation of our online offer, but is also for internal statistical purposes. This processing is based on our legitimate interest pursuant to Art. 6 para. 1 let. f GDPR.

  

2. Creation of a customer account

To place orders on our online store, you can order by creating a customer account. When you register for a customer account, we collect the following data:

- first and last name
- postal address
- date of birth
- telephone number
- email address
- password

This data is collected for the purpose of providing the customer with direct and password-protected access to their basic data, stored in our system. The customer can consult his completed and current orders or manage /modify his personal data.

Your consent according to Art. 6 para. 1 let. a GDPR is the legal basis for data processing for this purpose.

 

3. Purchase on the online store

If you wish to place orders on our online shop, we need the following data for the execution of the contract:

- first and last name
- billing address (if different from the delivery address)
- payment information (depending on the payment method chosen)
- identifiers, namely email address and password (for registered customers)

Unless otherwise provided in this Privacy Policy or lack of separate consent from you, we will only use the aforementioned data to perform this contract, including to process your orders, deliver the products ordered and ensure that payment is made correctly.

The performance of a contract in accordance with Art. 6 para. 1 let. b GDPR is the legal basis for data processing for this purpose.

 

4. Sound and video recordings

We may occasionally make photographs, videos and sound recordings of you, on or in which you may appear, for example if you take part in an event, are in contact with our customer service department or receive advice by videoconference.

For security and evidential purposes, we also make video recordings in our stores and other premises. This may provide us with information about your behavior in the relevant areas. We only use video surveillance systems in certain clearly identified areas.

Image and sound recordings include, for example: recordings of video surveillance systems; photos, videos and sound recordings of customer and public events; photos, videos and sound recordings of courses, presentations, training courses, etc.; recordings of telephone and video-conference conversations (e.g. in customer service or customer advice).

 

5. Transmission of data to third parties

We only pass on your personal data if you have expressly consented to this, if we are subject to a legal obligation to do so or if it is necessary to assert our rights, in particular to make our rights arising from the contractual relationship.

In addition, we pass on your data to third parties insofar as this is necessary for the use of the website and the performance of the contract (including outside the website), in particular for the processing of your reservations. This includes the carrier responsible for shipping the ordered goods. Our web host Kreativ Media GmbH, Höschgasse 45, 8008 Zurich is a service provider to whom we transmit the personal data collected via the website, or who has or may have access to it. The website is hosted on servers in Switzerland. The purpose of data transmission is to provide and maintain the functionality of our site. This is our legitimate interest pursuant to Art. 6 para. 1 let. f GDPR.

If we advance the services, e.g. when paying on account, we may request creditworthiness data from an information office on the basis of mathematical and statistical processes in order to safeguard our legitimate interests. For this purpose, we transmit to the information office Swissbilling SA, Rue du Caudray 4, 1020 Renens the personal data necessary for a credit analysis and use the information received regarding the statistical probability of inability to pay for a reasoned decision on the justification, execution or termination of the contract. Solvency data may include probability values (scores) calculated on the basis of scientifically recognised mathematical and statistical processes and in particular include contact details in their calculation. Your interests deemed worthy of protection are taken into account in accordance with the legal provisions. Our legitimate interest in data processing pursuant to Art. 6 para. 1 let. f GDPR lies in the purposes mentioned above.

Finally, we transmit to the issuer and the acquirer of your credit card the information relating to it when paying by credit card on our site. If you choose to pay by credit card, you must enter all the necessary information. The performance of a contract in accordance with Art. 6 para. 1 let. b GDPR is the legal basis for the transmission of data in this case. 6. Transmission of data abroad

We are also entitled to transmit your personal data to third-party companies (commissioned service providers) abroad for the data processing specified in this privacy policy. Before the data is transmitted to the provider, the IP address is abbreviated by activating IP anonymization ("anonymizeIP") on this website within member states of the European Union or in other signatory states to the Agreement on the European Economic Area. Google does not aggregate the anonymised IP address transmitted by your browser as part of Google Analytics with other data. Exceptionally, the full IP address is transmitted to a Google server in the USA and shortened there. In this case, we ensure through contractual guarantees that Google Inc. complies with a sufficient level of data protection. According to Google Inc., the IP address will not be associated with any other user data under any circumstances.

9. Note on data transmissions to the United States

For the sake of completeness, we inform users whose domicile or registered office is in Switzerland that the United States is subject to surveillance measures by the United States authorities. These generally allow the storage of all personal data of persons whose data have been transmitted from Switzerland to the United States. This is done without differentiation, limitation or exception based on the aim pursued and without objective criteria to limit the access of the US authorities to the data and their subsequent use to very precise and strictly limited purposes likely to justify the infringement implied by access to and use of such data. In addition, we inform you that in the United States, there is no legal remedy for data subjects from Switzerland that allows you to have access to data concerning you and to obtain their rectification or erasure, nor effective judicial protection against general access rights of the American authorities. 10. Right to information, rectification, erasure and restriction of processing; right to data portability

You are also entitled to demand the return of the data you have transmitted to us (right to data portability). On request, we also pass on the data to a third party of your choice. You have the right to obtain the data in a standard format.

12. Data retention

We only store personal data for as long as this is necessary for the use of the aforementioned tracking and analysis services as well as for further processing based on our legitimate interest. We keep the contractual data for a longer period since this is prescribed by the legal retention obligations. The obligations to retain that require us to retain data arise from the provisions relating to financial accounting and tax law.
